CONDICIONES DE VENTA

1.- El someter una oferta supone la aceptación tácita e incondicional de estas CONDICIONES DE VENTA.
2.- Todas las ofertas se harán por lote y de acuerdo a la numeración del presente catálogo. Nos reservamos el derecho de retirar cualquier lote, de dividirlos o agruparlos en dos o más lotes.
3.- El lote se adjudicará a la oferta más alta que se reciba, ya sea en el piso del remate o por correo, fax, correo electrónico, etc. En caso de que la oferta mayor sea de las recibidas por correo, etc., el lote se adjudicará a esta última, vendiéndose un incremento arriba de la oferta inferior aceptada por el subastador, ya sea por correo o en el piso. En caso de empate de dos o mas ofertas de las recibidas por correo, el lote se venderá a aquella que haya sido recibida primero. En caso de disputa, el subastador se reserva el derecho de decidir la adjudicación del lote en cuestión.
4.- Nos reservamos el derecho de rechazar ofertas que a nuestro juicio no sean de buena fé. NO SE ACEPTARÁN OFERTAS “SIN LIMITE”.

5.- El subastador NO ES RESPONSABLE POR ERRORES EN LAS OFERTAS. FAVOR DE CHECAR CIUDADOSAMENTE SUS OFERTAS.
6.- Las ofertas recibidas por correo, fax, correo electrónico, etc., serán aceptadas siempre y que se sujeten a los incrementos que se señalan a continuación:
Hasta $100 DLLS - $5 De $2,000 a $3,000 - $200
De $100 a $200 - $10 De $3,000 a $5,000 - $300
De $200 a $300 - $20 De $5,000 a $10,000 - $500
De $300 a $500 - $30 De $10,000 en adelante - $1,000
De $500 a $1,000 - $50 o a criterio del subastador.
De $1,000 a $2,000 - $100
En caso de que las ofertas que se reciban no se ajusten a estos incrementos, éstas se reducirán el nivel inferior.
7.- POR COMODIDIAD Y COSTUMBRE DEL MERCADO FILATELICO INTERNACIONAL; LA SUBASTA SE LLEVARÁ EN DOLARES AMERICANOS. SE ACEPTAN PAGOS EN PESOS, LOS CUALES SERÁN CONVERTIDOS AL TIPO DE CAMBIO QUE COTICEN LOS BANCOS O CASAS DE CAMBIO DE LA CIUDAD EN QUE TENGA LUGAR LA SUBASTA PUBLICA, UN DIA ANTES DE LA FECHA INICIAL DE LA SUBASTA.
8.- SE HARA UN CARGO ADICIONAL DEL 10% SOBRE EL PRECIO DE VENTA POR CONCEPTO DE RECUPERACIÓN DE GASTOS Y SERVICIO.
9.- El pago de los lotes podrá hacerse en Pesos Mexicanos o en Dólares Americanos.
10.- El pago de los lotes deberá hacerse, en el caso de compradores que asistan al piso de remates, inmediatamente después de la venta, cuando dicha persona desee retirarse del piso. A los oferentes por correo se les notificará el resultado en caso de haber adquirido algun(os) lote(s); NO SE ENTREGARA NINGUN LOTE QUE NO SE ENCUENTRE TOTALMENTE PAGADO.
11.- Todos los gastos por concepto de portes y manejo serán por cuenta del comprador. Todos los envíos se harán por CORREO REGISTRADO desde Monterrey, N.L., MEXICO. Favor de considerar un tiempo razonable antes de solicitar información sobre algún envío (ESTE NEGOCIO CONSTA DE UN SOLO EMPLEADO y el Correo no ayuda con los tiempos de entrega). Una vez que los lotes han sido depositados en el Correo y hayamos obtenido la contraseña correspondiente al registrado, NO NOS HAREMOS RESPONSABLES POR SU ROBO O EXTRAVÍO. Si el comprador desea que sus lotes le sean enviados por otro medio (servicio de mensajería acelerada); se hará el cargo correspondiente por flete y servicio por cuenta del comprador. NO EXISTE SEGURO EN MEXICO QUE CUBRA LOS RIESGOS DE ROBO O EXTRAVÍO EN CUALQUIER TIPO DE ENVIO; NACIONAL O INTERNACIONAL.

12.- Los lotes vendidos a los compradores por correo deberán ser pagados a mas tardar 10 días después de recibida la notificación correspondiente. La falta de puntualidad en el pago causará intereses de acuerdo a las condiciones de los CREDITOS BANCARIOS existentes en MEXICO.
13.- Las personas que asistan al remate recibirán una tarjeta numerada, la cual deberá ser utilizada para efectuar sus ofertas. Las ofertas recibidas con anterioridad al remate, serán operadas por el subastador EN FORMA CONFIDENCIAL.
14.- Todo el material se ofrece como GENUINO, a menos que en la misma descripción del lote se indique de otra forma. LAS FOTOGRAFIAS SON PARTE INTEGRAL DE LA DESCRIPCION. No se aceptarán devoluciones de: A) Lotes que contengan cinco estampillas o más. B) Lotes examinados con anterioridad a la subasta por el comprador o su agente designado. C) Lotes fotografiados por razones de centrado, márgenes, cancelaciones o dentado. D) Lotes que ya hayan obtenido un Certificado de Opinión de alguno de los Comités de Expertizaciones; cualesquiera que sea la opinión expresada en dicho certificado, a menos que al obtener una opinión actualizada, se cambie la opinión anterior. E) Lotes descritos como “SIN GARANTÍA”.
15.- Cualquier lote o sello que una autoridad filatélica competente y mutuamente aceptable declare por escrito no ser genuino, podrá devolverse. Si dicha autoridad no puede emitir una opinión por escrito de que la pieza es falsa (cuando se emite un certificado de “NO OPINION”), esto no es base para la devolución del lote. Cuando se desee enviar material a dicha autoridad para obtener una opinión, se deberá anotar claramente la palabra “EXTENSION” a un lado de la cantidad en la hoja de ofertas cuando ésta se haga por escrito o solicitarlo verbalmente al subastador al momento de la adjudicación en caso que que el comprador esté presente en el remate. LA FALTA DE CUMPLIMIENTO DE ESTE REQUISITO NOS LIBERA DE CUALQUIER RESPONSABILIDAD FUTURA. Los lotes que se envíen a peritaje, DEBERAN PAGARSE DE ACUERDO A LO ESTABLECIDO EN LAS CLAUSULAS 8, 9 y 10.
LOS NUMEROS DE CATALOGO SON DEL SCOTT; ULTIMA EDICION DISPONIBLE AL MOMENTO DE LA ELABORACION DEL CATALOGO. ALGUNAS VECES SE USA LA NUMERACION O PRECIOS DEL CATALOGO DE NICHOLAS FOLLANSBEE (Edición 2007) Y SE LE IDENTIFICA POR SUS INICIALES (NF).
LOS PRECIOS DE LA COLUMNA A LA DERECHA SON LOS DE APERTURA O INICIO EN DOLARES AMERICANOS; RESPETUOSAMENTE RECHAZAREMOS OFERTAS INFERIORES.
DICHOS PRECIOS DE APERTURA SON LOS FIJADOS POR EL SUBASTADOR AL REDACTAR EL CATALOGO; LOS CUALES PODRAN SER MODIFICADOS PRINCIPALMENTE POR YA TENER VARIAS OFERTAS RECIBIDAS PREVIAMENTE AL INICIO DEL REMATE.

CONDITIONS OF SALE

1.- The placing of a bid shall constitute full and unconditional acceptance of these CONDITIONS OF SALE.
2.- All bids are per lot as numbered in the catalogue. We deserve the right to withdraw any lot from the sale, to divide or re-group two or more lots together.
3.- The lot will be sold to the highest bidder, either by mail, fax, e-mail, etc., or in the floor. If the highest bidder is a mail bidder, the lot will be sold to him one increment above the second highest bid, by mail or in the floor. In case of tied mail bids, the lot will be sold to the first one received by us. The auctioneer will award the lot according to his criteria and his decision will be final.
4.- We deserve the right to reject bids believed by us not the be made in good faith. “BUY” bids are not accepted.

5.- The auctioneer IS NOT RESPONSIBLE for errors in bidding on the part of the bidder. PLEASE DOUBLE CHECK YOUR BIDS.
6.- All bids shall conform to the following table of increments:
Up to $100 DLLS - $5 From $2,000 to $3,000 - $200
From $100 to $200 - $10 From $3,000 to $5,000 - $300
From $200 to $300 - $20 From $5,000 to $10,000 - $500
From $300 to $500 - $30 From $10,000 on - $1,000
From $500 to $1,000 - $50 or up to the auctioneer.
From $1,000 to $2,000 - $100
In case of bids received that do not adjust to the previous table; they will be adjusted to the immediate lower limit.
7.- DUE TO CUSTOM AND TO MAKE THE EASIER, THE SALE WILL BE CARRIED IN U. S. DOLLARS. PAYMENTS IN PESOS WILL BE ACCEPTED AND CONVERTED ACCORDING TO THE GOING RATE OF EXCHANGE QUOTED BY THE BANKS OR EXCHANGE HOUSES OF THE CITY IN WHICH THE SALE WILL TAKE PLACE, ONE DAY PRIOR TO THE FIRST DAY OF THE SALE.
8.- THERE WILL BE A 10% CHARGE OVER THE SALE PRICE TO ALL THE LOTS DUE TO SERVICE AND EXPENSES.
9.- Payment of lots are accepted in Mexican Pesos or U.S. Dollars ONLY.
10.- Payment of lots will be made immediately after the sale, or for those persons attending the floor, whenever they want to leave. Mail bidders will be notified. NO LOT WILL BE RELEASED UNTIL PAID IN FULL.
11.- The successful buyer agrees to pay postage and handling charges. All lots will be mailed by REGISTERED MAIL from Monterrey, N.L., MEXICO. Please consider a reasonable period of time before inquiring about the mailing of lots (THIS IS A ONE-PERSON BUSINESS and we have little cooperation by the Mexican Post Office in regards to timings). Please note that once the lots are mailed and we have obtained the corresponding registration slip, we CANNOT BE RESPONSIBLE if they are lost or stolen. If the buyer wishes to use some of the express delivery companies, there will be an additional charge for this service. In Mexico there is no insurance policy to cover the risk of theft or loss.
12.- Lots sold to mail bidders should be completely paid not later than 10 days after receiving our notification. A late payment charge will be made to overdue accounts, the interest rate will be fixed according to the going rate in the MEXICAN BANKING SYSTEM.
13.- Each person attending the sale will be given a numbered card, which is to be used in bidding. Bids by mail will be handled CONFIDENTIALLY BY THE AUCTIONEER.
14.- All material is sold as GENUINE, unless within the description of the lot is specified otherwise. PHOTOGRAPHS ARE AN INTEGRAL PART OF THE DESCRIPTION. No returns will be accepted because of the following: A) Lots containing five or more stamps. B) Lots examined prior to the sale by the buyer or its appointed agent. C) Photographed material for reasons of centering, perforations, cancellations or margins. D) Lots that already have a Certificate of Opinion by any of the Expertization Committees, unless when requesting a new opinion, the previous one is modified. E) Lots described “AS IS”.
15.- Any lot or stamp which is declared to other than genuine by a competent and mutually accepted authority in writing, is returnable, however, when such authority renders a “NO OPINION” certificate, this shall not be grounds for a return. When the buyer wishes to send material for an opinion as to its authenticity, a notation as “EXTENSION” has to be made in the bidsheet in case of mail bidding; in case of floor bidders, the “EXTENSION” has to be requested to the auctioneer at the moment of purchase. THE LACK OF THIS MENTION RELIEVES US OF ANY FUTURE RESPONSIBILITY. Lots sent for expertization SHOULD BE PAID ACCORDING TO PARAGRAPHS 8, 9 and 10.
THE CATALOGUE USED IS THE LATEST SCOTT EDITION AVAILABLE AT THE MOMENT OF MAKING THIS LISTING. SOMETIMES THE NICHOLAS FOLLANSBEE CATALOGUE (2007 Edition) IS USED AND IDENTIFIED BY HIS INITIALS (NF).
ALL PRICES IN THE RIGHT HAND COLUMN ARE THE STARTING BIDS IN U.S. CURRENCY. WE WILL RESPECTFULLY DECLINE BIDS BELOW THESE PRICES.
SUCH STARTING BIDS ARE FIXED BY THE AUCTIONEER AT THE TIME OF WRITING THE CATALOGUE; BUT CAN BE MODIFIED, MOSTLY DUE TO HAVING RECEIVED BIDS PREVIOUSLY TO THE START OF THE SALE.
